Four families of transgender youth and two doctors challenged an Arkansas law that prohibiting healthcare professionals from providing or even referring transgender young people for medically necessary health care. The law also barred any state funds or insurance coverage for gender-affirming health care for transgender youth, and it would allow private insurers to refuse to cover gender-affirming care for people of any age. The lawsuit, filed in federal court, alleges that House Bill 1570 violated the U.S. Constitution.
On June 20, 2023, a federal judge ruled that the law was unconstitutional. Specifically, the judge held that it violated the Fourteenth Amendment’s Equal Protection and Due Process Clauses, as well as the First Amendment. The state was permanently enjoined from enforcing the law.
On October 6, 2023, the Eighth Circuit Court granted the state-defendants’ petition for initial hearing en banc. Oral arguments were heard before the Eighth Circuit on Thursday, April 11, 2024. Click HERE to listen to an audio recording.
